Service Description
Wisconsin Pest Control provides professional pest management services throughout the state of Wisconsin. Our services include, but are not limited to, residential and commercial pest inspections, treatment and control of insects, rodents, wildlife, and other nuisance pests, preventative maintenance programs, Integrated Pest Management (IPM) consultations, emergency pest removal, and follow-up monitoring visits. Specific treatment methods, products used, and service frequencies will be detailed in your individualized service agreement or work order. All services are performed by licensed applicators in accordance with Wisconsin Department of Agriculture, Trade and Consumer Protection (DATCP) regulations and applicable federal guidelines. Service areas, scheduling availability, and specific pest coverage may vary by location and season. We reserve the right to decline service for pest conditions outside our expertise or for properties that present safety hazards to our technicians.
No Guarantee or Warranty
Wisconsin Pest Control makes no express or implied guarantees regarding the complete elimination of pests from your property. Pest control outcomes depend on numerous variables beyond our reasonable control, including but not limited to pest biology and reproduction rates, environmental conditions, structural integrity of buildings, neighboring infestations, weather events, and client compliance with preparation and post-treatment instructions. While we employ industry-standard methods and licensed professionals, pest activity may persist or recur despite proper treatment. Any warranties or retreatment provisions, if offered, will be explicitly stated in your signed service agreement and are limited to the specific terms, timeframes, and conditions set forth therein. No oral representations made by technicians or staff shall create any warranty not contained in the written agreement. We do not guarantee against future infestations, property damage caused by pests, or health impacts related to pest presence.
User Responsibilities
By engaging our services, you agree to provide accurate and complete information regarding your property, pest concerns, and any conditions that may affect treatment safety or efficacy. You must disclose known allergies, chemical sensitivities, presence of pets, children, or vulnerable individuals, and prior pest control treatments. You are responsible for preparing the property as instructed, which may include cleaning, removing food items, securing pets, providing access to treatment areas, and vacating premises for specified periods. Failure to follow preparation instructions may result in service delays, additional charges, or reduced treatment effectiveness. You must inform us of any changes to property conditions, new pest activity between scheduled visits, or structural modifications that could impact pest entry points. Payment obligations must be fulfilled according to agreed terms. You agree not to interfere with treatment applications, tamper with bait stations or traps, or apply your own pest control products that may conflict with our treatments without prior consultation.
Limitation of Liability
To the fullest extent permitted by Wisconsin law, Wisconsin Pest Control and its officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, personal injury beyond physical harm directly caused by our negligence, property damage not resulting from our willful misconduct, emotional distress, or business interruption arising from or related to our services. Our total liability for any claim shall not exceed the total amount paid by you for the specific service giving rise to the claim during the twelve months preceding the incident. This limitation applies regardless of whether the claim is based on contract, tort, strict liability, or any other legal theory. We are not liable for damage to personal property, landscaping, or structures resulting from necessary treatment access, nor for the failure to detect pre-existing conditions concealed within walls, foundations, or inaccessible areas. You acknowledge that pest control involves inherent uncertainties and assume the risk of partial or incomplete treatment outcomes.
Intellectual Property
All content, materials, trademarks, service marks, logos, trade dress, photographs, videos, written materials, treatment protocols, proprietary application techniques, and software used or displayed by Wisconsin Pest Control are our exclusive property or used under license. This includes but is not limited to our website content, marketing materials, service documentation, inspection reports, and customer portal interfaces. You are granted no right or license to reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our intellectual property without prior written consent. Service reports and documentation provided to you are for your personal, non-commercial use related to the serviced property and may not be transferred, sold, or used to obtain services from competing providers. Any feedback, suggestions, or testimonials you provide may be used by us for marketing purposes without compensation. Unauthorized use of our intellectual property may result in legal action under federal and Wisconsin state laws.
Governing Law
These Terms of Service and any disputes arising from or relating to our services shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Dane County, Wisconsin, or the county where the serviced property is situated, at our discretion. You consent to the personal jurisdiction and venue of such courts. Both parties agree to attempt good-faith mediation of any dispute before initiating litigation. If any provision of these terms is found invalid or unenforceable under Wisconsin law, the remaining provisions shall continue in full force and effect. These terms do not create any third-party beneficiary rights. Wisconsin consumer protection statutes shall apply where mandatory, but your remedies under such statutes are subject to the limitations set forth herein to the maximum extent permitted by law.
Changes to Terms
Wisconsin Pest Control reserves the right to modify, amend, or update these Terms of Service at any time, with or without prior notice. Material changes will be posted on our website with an updated effective date and, where required by law, we will provide direct notice to clients with active service agreements. Your continued use of our services following the posting of revised terms constitutes your acceptance of such changes. If you do not agree to the modified terms, you must discontinue services and notify us in writing within thirty days of the change. Changes will not apply retroactively to services already rendered but will govern all subsequent service visits and renewals. We encourage you to review these terms periodically. The version in effect at the time of each service transaction shall govern that specific service. No waiver of any term shall be effective unless in writing signed by an authorized representative of Wisconsin Pest Control.
